Description
It is a fundamental right (item 29 EC) that is the right to individuals and groups to address the public authorities to extend facts or situations and to claim their intervention. In the words of the explanatory statement of the organic law 4/2001 of 12 november, regulating the Right of petition (LODP), we understand that “ as a means of expression in defence of the legitimate interests and as public participation in public work ”. The Constitutional Court has explained that the request “ is not a claim in the administrative procedure, or a complaint or an appeal to the judiciary, nor a complaint, the acceptance of the word offered by the Criminal law or regulatory authority of the punishment of Administration in its various sectors ” (STC 242/1993, of 14 july, FJ 1).

Goal of treatment

Data collection at the national level on inspections, maintenance, breakdowns and accidents of elevators, considering the provisions of the Royal Decree 355/2024, of 2 april, which approves the Supplementary Technical Instruction ITC AEM 1 "Lifts ’. This law regulates the commissioning, modification, maintenance and inspection of the lifts, as well as promoting the safety of existing elevator park. Such data will serve to assess the effectiveness of security measures implemented and to identify areas for improvement in the legislation, as well as in the management and operation of the lifts in the entire national territory.
